Dogbite In Illinois Chew On This

Dog bites are dangerous and terrifying very often resulting in pain and suffering. Illinois has very strict laws protecting the victim in such an eventuality. The dog bite laws in Illinois are stated in the Animal Control Act of USA which states that the owner or custodian of a dog or any other animal is liable to pay civil damages to the person to whom the injury is caused in full amount of the injury caused. Owner’s negligence is not a consideration here. The only two exceptions are

if the victim provoked the dog and

If the victim was not legally allowed to be at the place of the attack.

An owner may also be a person allowing a dog or animal to stay on any premises occupied by him. Additional claims can be made for negligence.

The Dog Bite Laws in Illinois state that the following may be compensated to the victim by the owner of the dog.

Medical bills, past, current and future bills related to the dog bite injury

Lost income because of the dog bite injury, both present and future.

Monetary Compensation for mental anguish such as nightmares in children as a result of the attack, or a newfound fear of dogs

Even when there has been no physical contact or injury to the person, claims can be made. This comes under the ‘’Zone of Danger’’ Doctrine.

Damage to property.

There are three major laws governing dog bites. Violating these laws can be the basis for liability.

A leash law requires that the dog is on leash when it is off the owner’s property.

The trespassing law makes it a crime for a dog to be on a person’s (other than its owner) property, without the knowledge of that other person.

The at-large law makes it a crime if the dog is without leash or not in the control of the owner on any property which is unfenced and not belonging to the owner.

Typically dog owners are expected to pay these damages from their homeowner insurance policies. Unfortunately, many insurers exclude all canine-inflicted (including dog bites) injuries from all homeowner and renter policies.

Illinois does not come under the ‘’one bite’’ or ‘’one free bite’’ rule which protects the owner from liability if it is the first injury caused by the animal. This in turn protects the insurance agency often at the expense of the injured who are children in most cases.

It is advisable that all dog owners ensure that they are covered adequately for the compensation claims of dog-bite victims.
